Peter Parker was an intern at Stark Industries, mostly helping Mr Stark with his many projects but also drifting between intern labs on the R&D floors, helping out whoever he could. Peter Parker, however, was first and foremost a kid in high school, a regular civilian. Everyone knew he would never kill anyone, knew he would never touch a gun, much less know how to use one.
Spider-Man was a vigilante in Queens, rarely drifting from his territory. Though he worked so closely with the Avengers on many occasions that he was widely accepted to be one of them himself, a hero of New York.
