Without Draco, the would have lost the war... but he is too perfect a poster child for Shaklebolt's new administration to put all Death Eaters on trial... starting with him. Everything he did for the Order of the Pheonix was buried and he was going to go to Azkaban for the rest of his life... he was going to set the example!
Hermione tried to reason with the Minister, believing that he was a just and fair man... surely there had been some mistake! But no... power corrupts awfully fast, apparently... She sees that now.
Underestimating Hermione Granger never goes well, no matter how bad her PTSD is, no matter how underweight and overtired she looks... She is smarter and more ruthless for a just and noble cause, every time.
Draco doesn't deserve to go to prison; this is the right thing to do... she would do it no matter what.
She also knows that she can't lose him... before she ever really has him... even if she never gets to, she can't do that.
