Disciplinary Actions and Enforcement Related to Vigilante Activity

Executive Summary

The Federal Bureau of Investigation holds its agents to the highest of ethical and legal standards. All agents have sworn an oath to uphold the Constitution of the United States, to bear true faith and allegiance, and to uphold the truth. Accordingly, agents are provided with training to meet this oath. This training is intended only to be used for sanctioned investigations.

Personnel who take extra-judicial actions, including vigilante activity, will be subject to a variety of sanctions. Vigilante activity is antithetical to the priorities and duties of this agency. As such, an agent suspected or proven to be engaging in extra-judicial activities will immediately be subject to an investigation by Internal Affairs. Upon completion of the investigation, appropriate disciplinary action will be taken. Evidence of vigilante activity will lead to immediate termination.

Conspirators within the Bureau will be subject to similar disciplinary action, including suspension, demotion, and termination. It is the responsibility of everyone, and most especially federal agents, to report their knowledge of a crime. Vigilante activity is illegal and will be prosecuted accordingly. The FBI will cooperate fully with any state or local investigations regarding Bureau employees and vigilante activity.

We made a promise two years ago. We swore to keep his identity a secret. This was in direct defiance of FBI policy, which has been in place since Agent Flores was unmasked.

NW also made it very clear at the time. He never expected us to lie for him. He never wanted to make our lives or careers more difficult due to the knowledge that we gained without his consent or intention.

As a team, we have acted to conceal his secret several times anyway. We have taken actions that implicate us in his secret. I don't know if the Bureau or Internal Affairs will find evidence of these actions. I don't know if, even if they don't, we will be able to remain together as a team or even agents of the FBI.

It is possible that, at this moment, the JL is working to cover up NW's unmasking. I don't know what tools they have to walk back such a global event, but I recognize that any testimony we give may nullify their efforts.

I do not want to place any pressure upon anyone to continue upholding this secret. NW does not want that.

My only request to each of you is that if you have any misgivings about continuing to uphold his secret, and the silence that we have maintained, that you announce so now. I and the rest of this team will not prevent you from speaking up.

After being unmasked by the Crime Syndicate, Nightwing was held captive for several hours. In that time, a combustive device known as a Murder Machine was integrated to Nightwing's biomarkers. This was discovered by Batman, Catwoman, and Lex Luthor.

Batman was unable to free Nightwing from the bomb in the short amount of time before it was set to explode. Luthor suffocated Nightwing. When Nightwing's heartbeat stopped, the device was deactivated.

Batman was unable to resuscitate Nightwing.
